GBI Investigates Brookhaven Officer-Involved Shooting After Home Invasion Shootout

At the request of the Brookhaven Police Department (PD), Georgia Bureau of Investigation (GBI) agents are investigating an officer-involved shooting that occurred on August 15, 2024, in Brookhaven, Georgia. Albert Eugene Burns, 19, of Snellville, GA, was injured in the incident. No officers were harmed.

At approximately 11:00 p.m. on August 15, Brookhaven PD officers were dispatched to a home invasion on Caldwell Road. The homeowner observed four armed gunmen inside her residence via surveillance video. She contacted a friend who arrived and confronted the suspects, resulting in a shootout between the suspects and the friend.

The suspects fled in a Lexus. A responding officer followed the vehicle into Chamblee, where the car crashed into a utility pole. The suspects exited the car and fled on foot. Burns, who was the driver, was armed with a gun. The officer fired at Burns, hitting him. Burns dropped one gun but continued to run, dropping a second gun as well. The officer fired again, striking Burns as he attempted to retrieve the dropped weapon.

Burns was apprehended and transported to a local hospital for treatment.

Dunwoody PD and Chamblee PD assisted with establishing a perimeter and conducting a K-9 search.

Davion Harper, 22, of Conyers, GA, and Tyson Kamari Kirksey, 18, of Conyers, GA, were apprehended without incident and will be booked into the DeKalb County Jail. The fourth suspect remains at large.

Brookhaven PD is investigating the home invasion and aggravated assault, while the GBI will carry out an independent investigation into the use of force by the officer.
