BALDWIN, Ga. — A former assistant police chief has been arrested following an investigation into missing funds from a department evidence room, according to the Georgia Bureau of Investigation.

Authorities said 41-year-old Justin Ferguson of Clarkesville, the former assistant chief of the Baldwin Police Department, has been charged with felony theft by taking and violation of oath of office.

The investigation began April 7, 2026, when the Baldwin Police Department requested the GBI to look into missing funds from its evidence room.

Investigators determined Ferguson was the primary custodian of the evidence room and responsible for the theft, officials said.

Ferguson was arrested and booked into the Habersham County Detention Center.

Ferguson had been placed on administrative leave and resigned from the police department in March. He had been with BPD since 2021. After his resignation, he was hired by the Toccoa Police Department, but resigned last week.

The investigation remains ongoing.

The Mountain Judicial Circuit District Attorney’s Office will be prosecuting the case once the investigation is over.
