Two Georgia Men Charged with Insurance Fraud Over False Stolen Vehicle Report

Frank Brake III, 32, of Lithonia, and Terry McMillian Jr., 32, of Monroe, have been charged with Insurance Fraud and Theft by Deception, Insurance and Safety Fire Commissioner John F. King announced Tuesday.

On February 14, 2023, the pair secured a $100,000 auto loan for a 2021 Jeep Track Hawk. In July 2023, they falsely reported the vehicle as stolen in an attempt to collect insurance money.

“Upon investigation, our agents determined the vehicle was never in possession of either suspect,” said Commissioner King. “By falsely reporting the vehicle as stolen, the duo was hoping to receive additional funds as reimbursement from their insurance company for a loss that never truly occurred.”

Warrants were issued in Walton County on March 12, 2025. Brake was arrested on March 20, while McMillian turned himself in on March 24. Both were later released on bond.

The Insurance Commissioner’s Office is working with the Walton County Sheriff’s Office in the ongoing investigation.
