OptumServe Settles Discrimination Allegations with Disabled Veteran for $85,000

The United States Attorney’s Office for the Northern District of Georgia has reached a settlement with OptumServe Health Services, Inc., a subsidiary of UnitedHealth Group, to resolve allegations of discrimination against a disabled veteran in violation of the Americans with Disabilities Act (ADA). The settlement follows an incident in which OptumServe refused to treat a veteran due to his service animal.
The veteran, who relies on the service animal for a service-related disability, was denied medical care during a scheduled appointment after being accompanied by the animal. As a result, the veteran left the medical facility without receiving any treatment.
U.S. Attorney Ryan K. Buchanan emphasized, “Service animals are not pets and are often prescribed to assist veterans diagnosed with particular service-related disabilities. Our office is committed to ensuring veterans have access to medical care that is free of discrimination.”
Under the terms of the settlement, OptumServe will modify its policies and provide additional staff training to comply with ADA requirements. Additionally, the company will pay $85,000 in compensatory damages to the affected veteran.
This case was managed by Assistant U.S. Attorney Marissa Fallica and Senior Civil Investigator Tamara Jones.
