Georgia DPS Issues Regulatory Relief for CMV Operators Amid Hurricane Helene Response
In response to Hurricane Helene’s impact, the Georgia Department of Public Safety (GDPS) has announced critical updates aimed at assisting the commercial motor vehicle (CMV) community. Governor Brian Kemp’s Executive Order 09.24.24.01, issued on September 24, 2024, provides specific regulatory relief for CMV operators delivering aid to affected areas.
The Executive Order temporarily suspends regulations limiting driving hours for CMV operators engaged in direct assistance. This measure is intended to ensure a continuous supply of essential goods and services necessary for the ongoing State of Emergency. Drivers who experience illness or fatigue must be granted at least 10 consecutive hours off-duty.
Additionally, the Executive Order permits size and weight exemptions for CMVs operating on Georgia’s roadways. Under the Stafford Act, carriers transporting relief supplies or conducting debris removal can also benefit from increased weight allowances on interstate systems. Carriers seeking to transport cargo outside the usual size and weight limitations can obtain a free permit by contacting the Georgia Department of Public Safety at (404) 635-8176 during regular business hours or through the online portal at www.gaprospermits.com. Details regarding additional size and weight limit increases are available in the Executive Order.
Furthermore, carriers and drivers providing direct assistance qualify for Federal exemptions outlined in the FMCSA Regional Emergency Declaration, effective until October 27, 2024. This declaration offers regulatory relief for various parts of the Federal Motor Carrier Safety Regulations (FMCSRs).
To aid in understanding these regulations and exemptions, GDPS encourages CMV operators to reach out with any questions at publicinfo@gsp.net. Additionally, the Commercial Vehicle Safety Alliance (CVSA) Emergency Declaration Portal (www.cvsaemergencydeclarations.org) serves as a resource for carriers and drivers to review Executive Orders across North America.
As the Georgia Department of Public Safety continues its efforts to support the state during this crisis, it remains committed to providing the necessary education and guidance to the commercial motor vehicle community.
