Cherokee County Man Convicted in Domestic Violence Case Involving Children
CHEROKEE COUNTY, Ga. — A Cherokee County jury has convicted a man on multiple charges stemming from a domestic violence incident in Canton, GA, officials announced.
District Attorney Susan K. Treadaway said that on March 27, 2026, a jury found Desmond Marquis Herbin guilty of false imprisonment, family violence battery, cruelty to children in the third degree, and criminal trespass following a five-day trial. Jurors found him not guilty of an additional count of cruelty to children in the third degree.
The charges stem from a November 20, 2023 investigation by the Canton Police Department at the River Ridge Apartments in Canton.
According to authorities, officers responded to a domestic dispute where a woman reported she had taken car keys in an attempt to leave an abusive relationship. Before she and the children could leave, Herbin allegedly pushed her against a wall near the front door, took her phone, and applied pressure to her neck until she lost consciousness.
The woman was able to escape the residence and flag down a passing motorist to call 911.
Officers reported observing visible red marks on the left side of her neck. Two children were present in the living room area during the incident.
During the trial, prosecutors called nine witnesses and presented 18 pieces of evidence, including the 911 call, body camera footage, photographs, and a video reenactment. The jury deliberated for approximately 12 hours before reaching a verdict.
The case was investigated by the Canton Police Department and prosecuted by Assistant District Attorney Ashley Snow of the Domestic Violence Unit in the Blue Ridge Judicial Circuit.
